SecurityTrack Media Submission & Copyright Agreement
By uploading photographs, videos or other media ("Media") to the SecurityTrack platform,
you agree to the terms of this Media Submission & Copyright Agreement.
Please read this agreement carefully.
By accepting this agreement you enter into a legally binding contract with SecurityTrack.
1. Original Ownership
You represent and warrant that:
- You are the creator and lawful copyright owner of the Media, or you possess all legal rights necessary to submit it.
- The Media is original.
- The Media does not infringe upon any copyright, trademark, privacy, publicity or other legal rights.
- You have obtained all required permissions from any identifiable individuals or property owners where applicable.
- You will not upload Media that belongs to another person or organisation.
2. Copyright Ownership
You retain ownership of the copyright and intellectual property rights in your Media.
Submitting Media to SecurityTrack does not transfer copyright ownership.
3. Licence Granted to SecurityTrack
By submitting Media, you grant SecurityTrack a
perpetual, worldwide, irrevocable, non-exclusive, transferable, sublicensable, and royalty-free licence to:
- Use, reproduce, copy, edit, modify and create derivative works from the Media.
- Display, publish, distribute and broadcast the Media.
- Use the Media within SecurityTrack's website, applications and services.
- Use the Media for advertising, promotional, editorial, educational and commercial purposes.
- License, sell or otherwise commercially exploit the Media.
- Grant sublicences to third parties to use the Media where SecurityTrack determines appropriate.
Because this licence is non-exclusive:
- You retain ownership of your copyright and intellectual property rights.
- You may continue to use, publish, sell, or license your Media yourself or through other platforms or organisations.
- You may grant licences to other parties, provided those licences do not interfere with SecurityTrack's rights under this Agreement.
- SecurityTrack may continue to use the Media under this Agreement even if you later license it to others.
4. Revenue Sharing
If SecurityTrack generates revenue through licensing or direct resale, the net revenue received will be divided as follows:
- 50% to the Submitter
- 50% to SecurityTrack
Net revenue means the amount received after taxes, payment processing fees, marketplace commissions and direct transaction costs.
5. Submitter Responsibilities
- The information you provide is accurate.
- Your Media complies with all applicable laws.
- You agree to indemnify SecurityTrack against claims arising from your breach of this Agreement or unlawful submission of Media.
6. Removal of Media
You may request removal of Media from public display but the final decision to remove it will rest with SecurityTrack. Wherever Media is removed, SecurityTrack may retain copies already archived, licensed, sold, distributed or incorporated into existing products, marketing or contractual arrangements.
The exclusive licence remains in force unless SecurityTrack agrees otherwise in writing.
7. Limitation of Liability
To the fullest extent permitted by law, SecurityTrack shall not be liable for indirect, incidental or consequential damages arising from your Media submission.
8. Governing Law
This Agreement shall be governed by the laws applicable to the jurisdiction in which SecurityTrack operates, unless otherwise required by law.
9. Acceptance
By accepting this Agreement, you confirm that:
- You have read and understood this Agreement.
- You are legally entitled to submit the Media.
- You grant SecurityTrack the exclusive licence described above.
- You agree to be legally bound by these terms.
